Title: Legal protection of the potato bass

I'm researching the status of legal protection of the potato bass in the Western Indian Ocean and got stuck with the SA situation. Need you help and clarification...

The potato bass is protected under the Marine Living Resources Act of 1998, listed in Annexure 5. Now, I could not download the annexure in pdf from the net but have the full Act.

From all the goggling I did (ended up in several fishing sites), I got the impression that the list of species in Annexure 5, only applies to recreational fishing?! Is that so?

Can anyone please send me the full Act and the annexures!?  :tkx:

Appreciate any help.

JohnF, is this the one you were looking for? It looks like Annexure 5 has to do with Tuna Pole fishing.  :dunno: :cnfzd

Now with regards to penalties... I'm under the impression that there is not a fixed fine/penalty... there is a "roof" (less than R3 mil or 8 years jail time) but it all depends on the circumstances and is at the court's decision? Is this correct?

Sorry I can't help you with the legal stuff but I think it is correct that it depends on the circumstances and it is the courts decision.
